TOUR OF INSPECTION

Shortly after roll-call the Commission will leave the Council chamber for an on-site Tour of Inspection of all properties listed on the agenda (including those on the Consent Agenda). The tour may include projects previously approved by the City and not on this agenda. Prior to the beginning of the tour, the Commission may eliminate one or more on-site visits. The public is welcome to join the Commission on its tour. The Commission will return to the Council chamber at 3:45 p.m. or as soon thereafter as possible.

PUBLIC APPEARANCES

Members of the public are entitled to speak on matters of municipal concern not on the agenda during Public Appearances. Each person's comments shall be limited to 3 minutes, or as otherwise established by the Commission. Matters not appearing on Commission's agenda will not receive action at this meeting but may be referred to staff for a future meeting. Persons are not required to give their names, but it is helpful for speakers to state their names so that they may be identified in the minutes of the meeting.

ANNOUNCEMENTS
CONSENT AGENDA

Items on the consent agenda are routine in nature and do not require discussion or independent action. Members of the Commission or the public may ask that any items be considered individually for purposes of Commission discussion and/ or for public comment. Unless that is done, one motion may be used to adopt all recommended actions.

1.Consideration of a Use Permit Amendment (UP 18-380) to modify the hours of operation for a Personal Improvement Service located in the Carmel Plaza on the South East corner of Ocean and Mission, in the Central Commercial (CC) Zoning District.
PUBLIC HEARINGS
2.Consideration of a Final Design Study (DS 18-252, Li) and associated Coastal Development Permit for demolition of an existing residence and construction of a new two-story residence, located on North Camino Real, 2 SW of 2nd Avenue in the Single-Family Residential (R-1) Zoning District.
3.Consideration of a Use Permit (UP 18-366) amendment to an existing full-line restaurant (Casanova) proposing to separate the north commercial space (fronting on 5th Ave.) from the south commercial space (fronting on Mission St.) creating two separate restaurants, re-configuring the indoor and outdoor seating and proposing new hours of operation. This use permit is for the north space (Casanova Restaurant) located on 5th Avenue, 2 SW of Mission Street in the Service Commercial (SC) Zoning District.
4.Consideration of a Design Review (DR 18-400) for the demolition and reconstruction of an existing restaurant building and minor modifications to the courtyard located at Lincoln Lane in the Service Commercial (SC) Zoning District.
5.Consideration of a combined Concept and Final Design Study (DS 18-378) and associated Coastal Development Permit for a 537 square-foot addition to an existing single-family residence located on Vizcaino, 6 southwest of Mountain View Avenue in the Single-Family Residential (R-1) Zoning District.
6.Consideration of a Concept Design Study (DS 18-349), Lot Merger (LM 18-350), and associated Coastal Development Permit for the demolition of an existing residence, the merging of two lots, and the construction of a new one-story residence with a basement located at the northwest Corner of Casanova & 13th Avenue in the Single-Family Residential (R-1) Zoning District.
7.Review of three (3) landscape lighting design options within the medians along Ocean Avenue for the purpose of making a recommendation to the City Council.
8.

Preliminary review of a proposed Rezone (ZC 17-277) of portions of Block 54 from Single Family Residential (R-1) to Residential & Limited Commercial (RC) located on the W/S of Lincoln Street and the east side of  Monte Verde Street between 5th and 6th Avenues in the Single-Family Residential (R-1) Zoning District.  The Planning Commission will be reviewing this item for the purpose of making recommendations to the City Council.

CHALLENGING DECISIONS OF CITY ENTITIES
The time limit within which to commence any lawsuit or legal challenge to any quasi-adjudicative decision made by the City of Carmel-by-the-Sea is governed by Section 1094.6 of the Code of Civil Procedure, unless a shorter limitation period is specified by any other provision, including without limitation Government Code section 65009 applicable to many land use and zoning decisions, Government Code section 66499.37 applicable to the Subdivision Map Act, and Public Resources Code section 21167 applicable to the California Environmental Quality Act (CEQA). Under Section 1094.6, any lawsuit or legal challenge to any quasi-adjudicative decision made by the City must be filed no later than the 90th day following the date on which such decision becomes final. Any lawsuit or legal challenge, which is not filed within that 90-day period, will be barred. Government Code section 65009 and 66499.37, and Public Resources Code section 21167, impose shorter limitations periods and requirements, including timely service in addition to filing. If a person wishes to challenge the above actions in court, they may be limited to raising only those issues they or someone else raised at the meeting described in this notice, or in written correspondence delivered to the City of Carmel-by-the-Sea, at or prior to the meeting. In addition, judicial challenge may be limited or barred where the interested party has not sought and exhausted all available administrative remedies.
