SUBJECT:

DS 23-180 (Nash): Consideration of a request for a time extension of Design Study DS 23-180 (Nash) and associated Coastal Development Permit for a substantial alteration to an existing two-story residence located on Monte Verde Street 3 southwest of 13th Avenue in the Single-Family Residential (R-1) District. Executive Summary:

The project includes interior and exterior alterations to an existing two-story residence and the demolition and reconstruction of a detached garage in the front yard setback. No trees are proposed for removal. The property was reviewed for historical significance, and a determination of historic ineligibility was issued on November 30, 2021.



Recommendation:
Adopt a Resolution (Attachment 1) approving a time extension for Design Study approval DS 23-180 (Nash), and associated Coastal Development Permit for a substantial alteration to an existing two-story residence located at Monte Verde Street 3 southwest of 13th Avenue in the Single-Family Residential (R-1) District. APN 010-176-018-000


Background and Project Description:
The project includes a 24-square-foot single-story addition, demolition of a 188-square-foot detached garage in the front yard setback, construction of a new 224-square-foot detached garage in the front setback, changes in exterior materials, windows, doors, chimneys, skylights, fences, site coverage, and landscaping.

On December 13, 2023, the Planning Commission adopted Resolution 2023-064-PC approving the project with conditions.

On September 12, 2024, Adam Jeselnick, Architect, submitted a request for a time extension on behalf of the owner, Jan E Nash TR. The owner is not currently in a rush to move forward with the project and is requesting a permit extension.


Staff Analysis:
Carmel Municipal Code Section 17.52.170 (Time Limits on Approvals and Denials) states that a residential design review permit is valid for 12 months from the date of action. The Code allows the Planning Commission to grant one extension of the permit approval. If, since the date of the original approval, the conditions surrounding the original approval have changed, or the General Plan, municipal code or Local Coastal Plan Program has been amended in any manner which causes the approval to be inconsistent with these plans or codes, no time extension or renewal shall be granted for any approval. There have been no pertinent changes to the General Plan, Municipal Code, or Local Coastal Program since this project was approved on December 13, 2023, that would require the project to be reevaluated. Staff recommends that the Commission grant the time extension.


Other Project Components:
On December 13, 2023, the Planning Commission found the project categorically exempt from the California Environmental Quality Act (CEQA), State CEQA guidelines, and local environmental regulations, pursuant to Section 15301 (Class 1) – Existing Facilities. Class 1 exemptions include additions to existing structures provided that the addition will not result in an increase of more than 50 percent of the floor area of the structures before the addition or 2,500 square feet, whichever is less. The proposed project does not present any unusual circumstances that would result in a potentially significant environmental impact. No exceptions to the exemption exist pursuant to section 15300.2 of the CEQA Guidelines.
