CONSENT AGENDA

TO:

Honorable Mayor and City Council Members
SUBMITTED BY:

Britt Avrit, City Clerk
APPROVED BY:

Chip Rerig, City Administrator
SUBJECT:Adopt Resolution 2020-029, amending Policy C95-01 Claims Against the City
RECOMMENDATION:
Adopt Resolution 2020-029, amending Policy C95-01 Claims Against the City.
BACKGROUND/SUMMARY:

On January 10, 1995, the City adopted Resolution 95-06 rescinding Policy 89-18 and Resolution 94-46, and incorporating and amending the substance of both documents into Policy C95-01. Upon further review of the Policy, it was determined the authority to deny claims had not been addressed in Policy 89-01.

The amendment provided in Exhibit A to Resolution 2020-029 updates the Policy to provide the City Administrator the authority to delegate denying and settlement of claims against the City up to $50,000.

The Policy continues to provide that the City Administrator is authorized to present any claim to the City Council at his, or her, sole discretion.

FISCAL IMPACT:
No direct fiscal impact for this action.
PRIOR CITY COUNCIL ACTION:

Adopted Resolution 94-46, April 5, 1994 delegating authority to the City Administrator to perform certain functions concerning processing of claims against the City.

Adopted Resolution 95-06, on January 10, 1995, rescinding Policy 89-18 and Resolution 94-46 and consolidating the information into Policy C95-01.
