| | | | | | | | Executive Summary: | The applicant has requested to amend the hours of operation allowed under Use Permit UP 18-380, previously approved on December 12, 2018. The current use permit allows the fitness studio to offer classes between 6:30 AM and 8:00 PM with all classes ending by 9:00 PM. The applicant wishes to amend the hours of operation to allow for classes to begin at 6:00 AM. |
Recommendation: | Staff recommends that the Planning Commission approve Use Permit (UP 18-380) subject to the attached Findings for Approval and Conditions of Approval (Attachments 1 and 2). |
Background and Project Description: | On December 12, 2018, the Planning Commission approved Use Permit UP 18-380 with conditions to allow for the establishment of Pure Barre, a Personal Improvement Service located in the Carmel Plaza. The business owner has requested an amendment to the Conditions of Approval to allow classed to begin a 6:00 AM rather than 6:30 AM as stated in the approved conditions of approval. No other changes to the use permit are requested. |
Staff Analysis: | Per the applicant, prior to the December 12, 2018 Planning Commission hearing, a miscommunication between the business owner and the applicant led to an error in the proposed hours of operation presented to staff for the personal improvement studio. Following the hearing, the business operator reached out to staff requesting the allowed hours of operation be changed from 6:30 AM to 6:00 AM. Staff supports the applicant’s request as the modified hours of operation do not conflict with the findings for a Use Permit or a Commercial Business. |
Other Project Components: | The application qualifies for a Class 3 Categorical Exemption from the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the State CEQA Guidelines. Class 3 exemptions include projects involving limited new construction and conversion of small structures from one use to another. |
